Ytterligere oppklaring om Dayton og Rambouillet avtalene kan være på sin
plass, selvom det uvegerlig fører med seg en del gjentakelser.
En gymnbaslærer lærte oss i en fjern fortid alltid først å lese
overskriftene i en bok hvis vi skulle ha håp om å forstå hva som sto i den.
La oss anvende dette prinsipp på Dayton-avtalen og på Rambouillet-"avtalen".
Den første har tre vedlegg som angår forholdet mellom NATO-styrker og hhv.
(1) Bosnia-Herzegovina, (2) Kroatia og (3) Jugoslavia. Den siste har til
sitt kapitel 7, et Appendix B som angår forholdet mellom NATO-styrker og
(4) Jugoslavia, inkl. den serbiske provins Kosovo.
La oss se nærmere på vedleggene i tur og orden:
(1) NATO/ Bosnia-Herzegovina. Teksten finnes på

(men NB! vi skal merke oss at det i selve teksten bare står nevnt

Poenget er at NATO faktisk har styrker i Kroatia og Bosnia-Herzegovina i
forbindelse med implementeringne av en avtalt fredsplan (Dayton-avtalen). I
henhold til den skal det ikke være stasjonert noen NATO-styrke i Jugoslavia
(= rest-Jugoslavia = FRY), men Milosevic tillater transitt av de
NATO-styrkene som har fredsoppgaver i Bosnia-Herzegovina og Kroatia.
Detaljtekstene i avtalene avspeiler dette forhold:
For NATO/Kroatia og NATO/Bosnia-Herzegovina (Dayton) gjelder at NATO har
vide fullmakter:
"9. NATO personnel shall enjoy, together with their vehicles, vessels,
aircraft and equipment, free and unrestricted passage and unimpeded access
throughout Croatia including Croatian airspace and territorial waters. This
shall include, but not be limited to, the right of bivouac, maneuver,
billet, and utilization of any areas or facilities as required for support,
training, and operations...."
For NATO/Jugoslavia (Dayton) gjelder at NATO ikke nyter vide fullmakter,
men FRY gir rett til transitt etter nærmere avtalte ruter:
"2. The Government of the Federal Republic of Yugoslavia shall allow the
free transit over land, rail, road, water or through air of all personnel
and cargo, equipment, goods and material of whatever kind, including
ammunition required by NATO for the execution of the Operation, through the
territory of the Federal Republic of Yugoslavia including Federal Republic
of Yugoslavia airspace and territorial waters.
4. ... The modes of transport will be communicated by NATO to the
Government of the Federal Republic of Yugoslavia in advance. The routes to
be followed will be commonly agreed upon ..."
Ser vi på Rambouillet-"avtalen", som ble forkastet av Jugoslavia (faktisk
av begge parter), kan vi Appendix B gjenfinne eksakt den samme ordlyd om
vide fullmakter:
"8. NATO personnel shall enjoy, together with their
vehicles, vessels, aircraft, and equipment, free and
unrestricted passage and unimpeded access throughout the
FRY including associated airspace and territorial
waters. This shall include, but not be limited to, the
right of bivouac, maneuver, billet, and utilization of
any areas or facilities as required for support,
training, and operations.... "
Fullmaktene beskrevet av denne ordlyd er altså konsekvent blitt avvist av
Jugoslavia/Milosevic.
For å vende tilbake tilbake til Kjell Arild Nilsens tese om at Milosevic,
siden han hadde undertegnet Dayton-avtalen vedrørende Jugoslavia, allerede
skulle ha samtykket i det som ble uttrykt i Rambouillet-avtalen, så viser
han at han ikke har forstått forskjellen på stasjonering og transitt av
NATO-styrker og heller ikke forskjellen på svært vide og snevre fullmakter
til verdens sterkeste militærmakt.
Men det har NATO og det har Milosevic. Krigen kjempes for/mot at NATO
styrkene skal få tilgang til hele Jugoslavia.
